Scotiabank Build Your Business Contest Official Rules

Contest Sponsor: The Bank of Nova Scotia (the “Contest Sponsor”).

  1. This contest commences at 12:01 AM ET February 28, 2008 and continues until 11:59 PM ET on July 31, 2008 (the “Contest Period”).
  2. No Purchase Necessary. To Enter: Go online to www.buildyourbusiness.scotiabank.com and fully complete the online entry form by providing your name, business name, business address, business email address and ten digit contact telephone number, and then submit your entry form online to receive one (1) entry into the contest (entrant may be an owner or manager or employee of the business). Earn a bonus entry by (a) entering the personalized bonus code found on your direct mail Build Your Business package from Scotiabank (if you received one); (b) completing the Blueprint for Business Checkup option online; and (c) earn up to three bonus entries by referring a colleague (one per each referral provided for a total limit of six entries per business. If it is discovered that a person or business attempted to enter more than six total entries all those entries will be void. To be eligible, all entries must be received during the Contest Period.
  3. This contest is open only to legal residents of Canada, who are over the age of majority in their province or territory of residence, excluding employees (and those with whom such employees are domiciled) of the Contest Sponsor, its advertising and promotion agencies and the independent judging organization. The contest is subject to all applicable federal, provincial and municipal laws and regulations.
  4. A random draw, conducted by the independent judging organization, from all completed entries received during the Contest Period will be made on August 1, 2008, at approximately 2:00 PM ET in Brantford, Ontario. Odds of winning depend on the number of eligible entries received. Selected entrants will be contacted by phone, email, mail or courier as indicated on his/her entry form within three (3) business days. Selected entrants are required to correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by telephone at a mutually convenient time, before being named a winner. The winners will be required to sign Scotiabank’s standard release documents before receiving the prize. Grand Prize winner’s travel companion, who must also be the age of majority for the province or territory in which they reside, must also sign Scotiabank’s standard release documents.
  5. If a selected entrant cannot be contacted by the independent judging organization within five business days, or if the entrant declines the prize, or does not otherwise comply with these Official Rules (the “Rules”), another random draw or draws will be conducted to select a replacement entrant in the same manner.
  6. If the identity of an online entrant is disputed, the authorized account holder of the email address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the email address for the domain associated with the submitted email address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry. All entries must be submitted from a valid email account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this contest will be the Contest Sponsor’s servers.
  7. There is one (1) Grand Prize available to be won, consisting of: a trip for two adults to Las Vegas, NV, USA, from anywhere in Canada. The Grand Prize trip includes round trip economy airfare from the international airport nearest to the winner’s home to Las Vegas, NV, for two, hotel accommodations for four (4) nights at the Bellagio hotel for two (based on double occupancy), return ground transportation from the destination airport to the hotel for two, tickets to the 2009 International Builders Show for two, and one thousand dollars ($1000.00 CDN) spending money. The approximate retail value of the Grand Prize is $5,000.00 CDN based on a Toronto departure example. Winner and travel companion are responsible for all other expenses including (but not limited to) other transportation, other entertainment, meals, merchandise and souvenirs, local and long distance telephone calls, taxes, travel and cancellation insurance, travel visas, gratuities, and all other personal expenses of any kind. Winner and travel companion must have all necessary identification and documents to permit travel (ie. Passport) to permit travel to the U.S. and no legal impediment to travel to the U.S. It is recommended that the winner and travel companion obtain sufficient personal insurance prior to departure. Trip must be taken January 20, 2009 to January 23, 2009, and will not be rescheduled or substituted once booked. No responsibility is assumed by the Contest Sponsor for cancelled, delayed, suspended or re-scheduled travel for any reason. Transportation and accommodations are subject to availability. Winner and travel companion will be required to travel together, on the same itinerary. There are five Second Prizes available to be won, each consisting of: a DeWALT Cordless Job site Radio and Charger, with an approximate retail value of two hundred dollars ($200.00 CDN). Allow six (6) to eight (8) weeks for delivery. There are twenty-five (25) Third Prizes available to be won, each consisting of: a one hundred dollar ($100.00 CDN) Canadian Tire Gift Card. Allow six (6) to eight (8) weeks for delivery.
  8. Prizes must be accepted as awarded and may not be transferred, or exchanged and have no cash surrender value. The Contest Sponsor agrees to abide by any corporate policies with respect to awarding of prizes to employees. Winners are responsible for the reporting and payment of any income taxes as a result of the prize. The Contest Sponsor reserves the right to substitute a prize or any portion of a prize for a substitute prize of at least equal value in the event of the unavailability, or for whatever reason.
  9. The Contest Sponsor’s rulings are final and without appeal in all matters related to this contest and the awarding of prizes.
  10. By entering this contest, each prize winner consents to the use of his/her name, city of residence, likeness and/or photograph in any publicity carried out by the Contest Sponsor, and its advertising and promotional agencies, without further notice or compensation to each prize winner.
  11. All entries become property of the Contest Sponsor. The Contest Sponsor assumes no responsibility for incomplete or inaccurate entries, entries that have been submitted through illicit means, or do not conform to or satisfy the Rules or for failure of the website during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from downloading any material in the promotion. The Contest Sponsor reserves the right, in its sole discretion, subject to approval from the Regie in Quebec, to cancel or modify this contest should a virus, bug or other cause beyond the reasonable control of the Contest Sponsor corrupt the security or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this contest is a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The Contest Sponsor is not responsible for any errors or omissions in printing or advertising this contest.
  12. The Contest Sponsor is collecting personal data about entrants for the purpose of administering this contest. No further informational or marketing communications will be received by entrants unless entrants provide explicit permission as indicated on the entry form.   13. By entering this contest, entrants release and hold harmless the Contest Sponsor from any liability in connection with this contest or participation in any contest related activities or, if declared a winner, the use or misuse of a prize and any travel related thereto. This contest will run in accordance with these Rules, subject to amendment by the Contest Sponsor. Contest Sponsor reserves the right, subject to approval from the Regie in Quebec, to cancel, amend, modify or terminate this contest or the Rules at any time in its sole discretion and without further notice. Entrants must comply with these Rules, and will be deemed to have received and understood the Rules if they participate in the contest.
  14. For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
